| dc.description | The phrase societas delinquere non potest has been for more than a century attributed to Roman Law. In European law, constructing Roman jurisprudence as a precedesor was particularly effective in legitimizing the denial of criminal liability to corporations. In Spain, for instance, legal persons were only considered subject to criminal law from 2010 onwards, through the LO 5/2010 (23rd of July). In this article, I show evidence to argue that the phrase was actually coined by German legal expert Franz von Liszt as late as 1881, in the first edition of his Das Deutsche Reichsstraftrecht. Because Listz wrote it in Latin, later authors soon started to assume its Roman origins and turned it into an axiom in the early years of the 20th century, obscuring until now the real origins and history of the phrase. | es_ES |
| dc.description.abstract | La tradicional atribución de la frase societas delinquere non potest al derecho romano ha influido notablemente en que los países con ordenamientos jurídicos de la Europa continental hayan reconocido muy tardíamente la responsabilidad penal de las personas jurídicas. Por ejemplo España solo ha reconocido a las personas jurídicas como sujeto penal a partir de la LO 5/2010, de 23 de junio. En este artículo aportamos las pruebas que demuestran que, en contra de lo que siempre se ha supuesto, la frase no tiene origen romano sino que fue inventada por el penalista alemán Franz von Liszt en 1881, en la primera edición de su manual Das Deutsche Reichsstraftrecht. El simple hecho de estar redactada en lengua latina ha provocado una confusión generalizada que ha impedido identificar hasta la fecha el verdadero origen de la frase, que solo fue popularizada como axioma en los primeros años del siglo XX. | es_ES |
