Este trabajo ésta dividido en dos partes.
En la primera, estudiaremos qué es la responsabilidad médica, sus tipos, normativa
reguladora y naturaleza jurídica de las relaciones médico-paciente. Analizaremos los
requisitos de la responsabilidad civil (acción u omisión, daño efectivo y nexo causal), así
como los criterios de atribución al propio causante del daño (negligencia, dolo, lex artis y
consentimiento informado) o a otro que responda por él.
En la segunda parte, veremos lo que conlleva concertar un seguro de responsabilidad civil
médica y si es obligatorio o no hacerlo. Seguiremos con la acción directa del perjudicado
contra la aseguradora y las objeciones y excepciones a esta regla. También distinguiremos los
elementos del seguro de responsabilidad civil médica., para finalizar con los pormenores de la
comunicación de un siniestro a la aseguradora, la obligación de ésta de investigarlo y las
posibles consecuencias de su inacción, tanto pecuniarias como procesales.
Descripción:
This work is divided into two parts.
In the first one, we will study what medical liability is, its types, regulatory rules and legal
nature of doctor-patient relationships. We will analyze the requirements of civil liability
(action or omission, effective damage and causal link), as well as the criteria for attribution to
the one causing the damage (negligence, fraud, lex artis and informed consent) or to another
respondent for it.
In the second part, we will see what it takes to arrange medical liability insurance and whether
it is mandatory or not. We will continue with the direct action of the injured against the
insurer and the objections and exceptions to this rule. We will also distinguish the elements of
medical liability insurance, to end with the details of the communication of a claim to the
insurer, the obligation of the insurer to investigate it and the possible consequences of its
inaction, both pecuniary and procedural.
