| dc.description | In this work, it is carried out an analysis of the legal regime of the permanence agreement in light of the interpretations realised by the doctrine, both scientific and jurisprudential, given the brief wording and the judicial conflict to which it has given rise. | dc.description.abstract | En este trabajo se lleva a cabo un análisis del régimen jurídico del pacto de permanencia a la luz de las interpretaciones llevadas a cabo por la doctrina, tanto científica como jurisprudencial, dada la escueta redacción del precepto estatutario y la conflictividad judicial a que ha dado lugar. El pacto de permanencia se configura en el art. 21 ET junto con otros pactos regulados en el mismo cuyo elemento que comparten en común es la limitación del derecho al trabajo ex art. 35 CE, en cuanto suponen una restricción de la libertad de la persona trabajadora en la resolución contractual cuando esta se compromete, a través de este pacto, a prestar servicios durante un período de tiempo por haber recibido una formación especializada para poner en marcha un proyecto o llevar a cabo un trabajo concreto. | es_ES |
