The deed of sale and its subsequent declaration of new work is not a sufficient title to legiti-mize the widow as owner by virtue of the community of property, which has not been accredited, but it is sufficient title to declare her as owner ad usucapionem 50% of the farm.es_ES
dc.description.abstractLa SAP de Palma de Mallorca 3ª de 28 septiembre 2021 se enfrenta a la cuestión sobre el régimen económico matrimonial formado del causante que no es el de comunidad de bienes, por no preverlo la ley inglesa ni haberse acreditado su existencia en virtud de pacto de los cónyuges. La escri-tura de compraventa y su posterior declaración de obra nueva no es título suficiente para que legitime como propietaria a la viuda en virtud de la comunidad de bienes, que no ha sido acreditado, pero sí es título suficiente para declararla como propietaria a usucapionem del 50% de la finca.es_ES
