dc.descriptionThis study examines the transformation of labor Law in response to the expansión of digital platforms, with particular emphasis on the food-delivery sector. It begins by analysing the historical construction of false self-employment, the evolution of the economically dependent self-employed worker (TRADE), ande the case law of the Spanish Supreme Court, culminating in Judgment 805/2020. Building on this foundation, the researck evaluates the legislative response embodied in the “Rider Law”, fosucing on its effects on the presumption of employment, algorithmic transparency and collective bargainign rights. The analisis is broadened through a European perspective: the case law of the CJEU (Allonby, Uber, Yodel) establishes an autonomous EU concept of “worker” grounded in the material conditions of the service performed. Directive (UE) 20024/2831 consolidates this approach through harmonised obligations of transparency, mandatory human oversight and a generalised presumption of employment. Overall, the study identifies a broader trend towards protective convergence and highlights the need to adapt labor protections to digitally organised work.
dc.description.abstractEl trabajo analiza la transformación del Derecho del Trabajo ante la irrupción de las plataformas digitales, con especial atención al sector del reparto. A partir del estudio de la construcción histórica del falso autónomo, la evolución del TRADE y la jurisprudencia del Tribunal Supremo, culminada en la Sentencia 805/2020, se examina la respuesta normativa española mediante la Ley Rider y su impacto en la presunción de laboralidad, la transparencia algorítmica y la negociación colectiva. El análisis se completa con la dimensión europea, en al que la jurisprudencia del TJUE (Allonby, Uber, Yodel) configura un concepto de autónomo de trabajador basado en la realidad material de la prestación. La Directiva (UE) 2024/2831 consolida este enfoque mediante obligaciones armonizadas de transparencia, supervisión humana y presunción de laboralidad. En conjunto, el estudio muestra una tendencia hacia la convergencia protectora y la necesidad de adaptar la tutela laboral a la organización digital del trabajo.
