dc.description.abstractLa actividad minera ilegal en la provincia de Pataz, ubicado en la Amazonía Peruana, se ha consolidado como un problema de seguridad nacional que desafía directamente la soberanía del Estado peruano, y es percibida por la población como una zona de alta y grave vulnerabilidad. Caracterizado por una marcada fragilidad institucional, este territorio se encuentra bajo el control fáctico de redes criminales que monopolizan la economía del oro. La ineficacia de las intervenciones bajo los Estados de Emergencia decretados, reflejan una alarmante tasa de criminalidad diaria, lo cual subraya la necesidad de un cambio de paradigma. Ante este escenario, el objetivo del presente trabajo es examinar las raíces socio-jurídicas del problema, conocer de cerca cómo ha venido actuando el Estado y evaluar la normativa aplicable, sirviendo como base para proponer una doctrina de intervención político-militar adaptada a la complejidad del territorio, orientada a erradicar la impunidad y salvaguardar los derechos fundamentales de los habitantes de la comunidad de Pataz.
dc.description.alternativeIllegal mining in the province of Pataz, located in the Peruvian Amazon, has become a national security issue that directly challenges the sovereignty of the Peruvian state and is perceived by the population as an area of high and serious vulnerability. Characterized by marked institutional fragility, this territory is under the de facto control of criminal networks that monopolize the gold economy. The ineffectiveness of interventions under the declared states of emergency is reflected in an alarming daily crime rate, which underscores the need for a paradigm shift. Given this scenario, the objective of this study is to examine the socio-legal roots of the problem, gain an in-depth understanding of how the state has been acting, and evaluate the applicable regulations, thereby laying the groundwork for proposing a doctrine of political-military intervention adapted to the complexity of the territory, aimed at eradicating impunity and safeguarding the fundamental rights of the residents of the Pataz community.
