Análisis de la prisión permanente revisable. ¿justicia o venganza?

La Constitución Española de 1978 (en adelante CE), norma que representa la
concepción del pueblo español sobre la idea de Libertad y Justicia, considera a los presos
como sujetos de derechos fundamentales. Bajo esta misma escala de valores superiores
establece que las penas privativas de libertad y las medidas de seguridad estarán orientadas
hacia la reeducación y la reinserción social (art. 25.2 CE). En el presente trabajo analizaremos
la necesidad de la figura de la prisión permanente revisable como máximo paradigma
retributivo simbólico, en respuesta a la idea de fracaso de la reeducación y la reinserción
social y a la necesidad de fortalecer la confianza de la sociedad en la Administración de
Justicia, abordando desde una perspectiva criminológica el impacto social que ha supuesto la
instauración de esta pena de prisión en el ordenamiento jurídico español.
Descripción:
The Spanish Constitution of 1978 (hereinafter CE), a norm that represents the
conception of the Spanish people on the idea of Freedom and Justice, considers prisioners as
subjects of fundamental rights. Under this same scale of higher values, it establishes that
custodial sentences and security measures will be oriented towards reeducation and social
reinsertion (art. 25.2 CE). In the present work, we will analyze the necessity of the figure of
the permanent prison reviewable as máximum symbolic retributive paradigm, in response to
the idea of failure of the reeducation and social reinsertion and the need to strengthen the trust
of society in the Administration of Justice, addressing from a criminological perspective the
social impact that the establishment of this imprisonment in the Spanish legal system has
entailed.
