dc.descriptionThe main purpose of this study is to analyze the differences and similarities between the constitution’s theories of Rudolf Smend and Konrad Hesse with a particular attention to the interpretation of fundamental rights. Beginning with the strict connection between constitutionalism and fundamental right presenting the prevalent ideas in the two theories and at the end evaluate how the theories of Smend and Hesse aren’t exactly opposite and have many points in common, especially on the fundamental rights interpretation. The review of aspects of the two theories may be useful in the difficult task of giving greater effect to these rights.es_ES
dc.description.abstractO presente estudo pretende analisar as divergências e convergências entre as teorias da constituição de Rudolf Smend e Konrad Hesse, especialmente no que se refere à interpretação dos direitos fundamentais. Considerando-se a relação entre o constitucionalismo e os direitos fundamentais, apresentam-se as ideias prevalentes nas duas teorias citadas no título, para, ao final, avaliar como as teorias de Smend e Hesse não são propriamente contrapostas, especialmente no que diz respeito à interpretação dos direitos fundamentais. A revisão de aspectos das duas teorias poderá ser útil na difícil tarefa de se dar maior eficácia a esses direitos.es_ES
