La salud como derecho humano, enfermedades huérfanas, protección efectiva invocada ante Sanidad Militar en Colombia

El derecho a la Salud en Colombia es vital, máxime si se trata de enfermedades huérfanas y raras, dónde existen vacíos médicos y jurídicos para su protección especial. Esta investigación es soportada en el análisis, en primer lugar, de las normas vigentes, como la Carta Magna, la ley de la salud, el código penal, el decreto que reglamenta la acción de tutela, leyes y decretos del Sistema y Subsistema de Salud de las Fuerzas Miliares; en segundo lugar, de la jurisprudencia de la Corte Constitucional; en tercer lugar, de la realidad, que en ciertos casos contraría la primera, porque buscando la protección efectiva ante algunas instituciones del Estado y del orden particular, se hallan brechas que distan en vez de unir los polos en beneficio de este derecho fundamental ligado a la dignidad humana y que somete a una puesta en grave riesgo de la integridad y vida misma.

The right to health in Colombia is vital, especially if it is orphan and rare diseases, where there are medical and legal gaps for their special protection. This research is supported by the analysis; first, the regulations in force, such as the Magna Carta, the health law, the penal code, the decree that regulates the tutela action, laws and decrees of the Health System and Subsystem of the Military Forces; secondly, the jurisprudence of the Constitutional Court; thirdly, the reality that in certain cases contradicts the first, because seeking effective protection before some institutions of the State and the particular order, there are gaps that are far from being at risk instead of uniting the poles for the benefit of this fundamental right linked to human dignity and that subjects to a serious risk of integrity and life itself.
