| dc.description | The WHO and the UN have been warning for more than three decades about the disrespectful, offensive or negligent treatment that women receive during childbirth in health centers. We are facing a normalization of practices that are obsolete and represent a violation of human rights, as a violation of the right to health and as a manifestation of gender violence. In Spain there is an abuse of the medicalization of childbirth, the rates of cesarean sections and inductions are very high and, on many occasions, informed consent is violated. The aim of this paper is to examine this type of practice from a social and legal perspective, reflecting the most recent statistics and positions, and carrying out a detailed analysis of the problem, the main legal mechanisms for dealing with it, with special mention of the criminal route, as well as the challenges presented by its possible legal classification. | es_ES |
| dc.description.abstract | La OMS y la ONU llevan más de tres décadas alertando del trato irrespetuoso, ofensivo o negligente que reciben las mujeres en los centros de salud durante el parto. Nos encontramos ante una normalización de prácticas que están obsoletas y que suponen una violación de derechos humanos, como una vulneración al derecho a la salud y como una manifestación de violencia de género. En España existe un abuso de la medicalización del parto, las tasas de cesáreas e inducciones son muy altas y, en multitud de ocasiones, el consentimiento informado es vulnerado. En este trabajo se busca profundizar sobre este tipo de prácticas desde una perspectiva social y legal, reflejando las estadísticas y posturas más recientes, y realizando un análisis pormenorizado de la problemática, de los principales mecanismos legales para afrontarla, con especial mención a la vía penal, así como de los retos que presenta su posible tipificación. | es_ES |
