| dc.description | Squatting is nowadays a current issue. The amount of squatters has been increased in the last years due to the economical crisis. The solution given by the government includes three different points of view: civil, criminal and administrative. In this paper, we will mainly focus on the strand given by Criminal Code, article 245.2, and also on the ones brought by the Civil Code and the Citezen Safety Law. At the end, we will give a Police Force point of view of this matter and talking about two new organisations, “Squatter Mafia And Desokupa”, who have risen thanks to the business created by squatting. | es_ES |
| dc.description.abstract | La ocupación se ha convertido en un tema de actualidad. Con la crisis la cantidad de viviendas ocupadas ha crecido exponencialmente. La solución ofrecida por nuestros legisladores a este problema abarca tres puntos de vista, el civil, el penal y el administrativo. En el presente trabajo trataremos principalmente una de esas vertientes, la ofrecida por el Código Penal, la “Usurpación pacífica de bienes inmuebles”, artículo 245.2, dando pequeñas pinceladas sobre las otras dos vías, que figuran en el Código Civil y en la Ley de Protección a la Seguridad Ciudadana. Se finalizará con una visión policial del fenómeno y con dos instituciones (las mafias y la empresa Desokupa) que han nacido aprovechando el negocio que ha generado la ocupación. | es_ES |
