Resumen:
Este trabajo de investigación pretende estudiar las características intrínsecas de la
moneda virtual más representativa de entre todas las criptomonedas existentes en el
mercado, el Bitcoin, considerándola desde dos puntos de vista: como medio de pago
en el intercambio de bienes y servicios; y de otro como un activo financiero o de
inversión con fines especulativos a corto y medio plazo.
Asimismo, se hará referencia a las distintas corrientes regulatorias en cuanto a su
naturaleza jurídica y, en especial, al tratamiento fiscal en la Unión Europea, los
Estados Unidos, y otras jurisdicciones seleccionadas.
El objetivo último de esta investigación es analizar las actuales deficiencias del
estado jurídico global del Bitcoin a efectos de llevar a cabo las correspondientes
recomendaciones que permitan una aproximación al control global de la fiscalidad y
protección de los consumidores.

This research work aims to study the intrinsic characteristics of the most
representative virtual currency among all the existing cryptocurrencies in the market,
Bitcoin, considering it under two points of view: as a means of payment in the
exchange of goods and services and as a financial or investment asset for
speculative purposes in the short and medium term.
Likewise, reference will be made to the different regulatory flows in terms of their
legal nature and, in particular, to the tax treatment in the European Union, the United
States and other selected jurisdictions.
The ultimate goal of this research is to analyze the current deficiencies of the global
legal status of Bitcoin in order to carry out the corresponding recommendations that
allow an approximation to the global control of taxation and consumer protection.
