La Ley de Seguridad Ciudadana y su impacto en los derechos a la vida, integridad física y moral y a la libertad religiosa y de culto

La Ley Orgánica de Protección de la Seguridad Ciudadana, 4/2015, (en adelante LOPSC), de fecha 30 de marzo del año 2.015, trajo consigo un amplio debate sobre la posible transgresión de ciertos derechos fundamentales en algunos de los artículos contenidos en su redacción, poniéndose de manifiesto discrepancias entre grupos de ciudadanos, hasta el punto de ser conocida la referida ley como «Ley Mordaza» y la presentación en su contra de diversos recursos de inconstitucionalidad a la espera de su resolución. Así, pues, el trabajo planteado incide en la interpretación otorgada a los artículos 16, 18, 19 y 20 de la LOPSC, donde se regulan las comprobaciones, identificaciones, registros y traslado si procede a dependencias policiales y su posible afectación a algunos preceptos contenidos en la Constitución Española con especial referencia al artículo 15 sobre el derecho a la vida, a la integridad física y moral y la prohibición de tratos inhumanos y degradantes y al artículo 16 sobre la libertad ideológica, religiosa y de culto. Todo ello a la luz de la normativa europea, las leyes internas y la amplia jurisprudencia existente en la materia.

The Organic Law for the Protection for the Citizen Security Protection, 4/2015; (hereinafter LOPSC), dated on the 30th of March of the year 2015, brought with it a broad debate about the possible transgression of certain fundamental rights in some of the articles contained in its wording. Some discrepancies were revealed among groups of citizens, to the point that the referred law was being known as "Gag Law" as well as the presentation against it of several unconstitutional appeals still pending from their resolutions. Thus, the proposed work affects the interpretation given to Articles 16, 18, 19 and 20 from the LOPSC, where the verifications of identifications, registers, and their possible application to certain precepts contained in the Spanish Constitution, are regulated. A special reference should be given to the articles 15, about the right to life, to physical and moral integrity and the prohibition of inhuman and degrading treatment, and to the article 16 about ideological and religious freedom and worship. All this watched under the European regulations, the internal laws and the extensive existing jurisprudence existing of the subject.
