| dc.description | In 2015, the Spanish government approved the 1/2015 Law (30th of March), which reformed the Criminal Code. The society asked for a reform of the Criminal Law because of the relation of the increase of the criminality with the massive arrival of immigrants in the first decade of this century. For this reason, one of its amendments was the article 89, which refers to the substitution of custodial sentences by expulsion. This article has undergone several reforms over the years and no one has ever been completely satisfied with them. This last reform introduces changes such as the non-differentiation of legal and illegal foreign resident or the modification of the number of years of the condemnation to accede to the expulsion. Context, comparative law and the analysis of the matter, both doctrinal and jurisprudential, are the bases on which this work is based to try to explain this topic. | es_ES |
| dc.description.abstract | En 2015, el gobierno aprobó la Ley 1/2015 de 30 de marzo por la que se reformaba el Código Penal. La sociedad pedía una reforma del mismo ante la relación del aumento de la criminalidad con la llegada masiva de inmigrantes en la primera década de este siglo. Por ello, una de sus modificaciones era la del artículo 89, referente a la sustitución de penas privativas de libertad por expulsión. Este artículo ha sufrido varias reformas a lo largo de los años y nunca nadie ha estado satisfecho completamente con su redacción. Esta última reforma introduce cambios como la no diferenciación de residente legal e ilegal extranjero o la modificación del número de años de la condena para acceder a la expulsión. El contexto, el derecho comparado y el análisis de la materia, tanto doctrinal como jurisprudencial, son las bases en las que se fundamenta este trabajo para intentar explicar este tema. | es_ES |
