| dc.description | In recent years, the exercise of the freedom to work has found new ways of expression. Indeed, the COVID-19 pandemic2 demonstrated that numerous tasks can be carried out through remote work or teleworking. Once the health crisis was overcome and normalcy restored, these modalities came to be regarded as plausible ways of working. Following this realization, the necessary legislative regulation was introduced to safeguard the rights and obligations of the parties involved, providing legal certainty and ensuring—so far as possible—the same rights afforded to on-site work. Within this context, one of the challenges lies in the prevention of risks and in the treatment of accidents occurring in connection with or because of remote work or teleworking. | dc.description.abstract | En los últimos años el ejercicio de la libertad de trabajo ha encontrado nuevos modos de expresarse. En efecto, la Pandemia de la COVID-191 mostró que numerosas tareas pueden desarrollarse mediante trabajo a distancia o teletrabajo. Superada la crisis sanitaria y recobrada la normalidad, se les ha considerado como un modo plausible de trabajar. Tras esa constatación vino la necesaria regulación legislativa para resguardar los derechos y obligaciones a las partes involucradas, brindándoles seguridad jurídica y garantizándose -en la medida de lo posible- los mismos derechos que al trabajo presencial. En este contexto uno de los desafíos es la prevención de riesgos y el tratamiento de los accidentes ocurridos con ocasión o por consecuencia del trabajo a distancia o teletrabajo. El análisis de esta cuestión es el objeto de este texto. | es_ES |
