Protección de datos de los menores de edad y el denominado fenómeno “sharenting”

Es muy común actualmente ver a menores de edad en las redes sociales, incluso ejerciendo como “influencers” o con cuentas personales “administradas” por sus progenitores. Lo cierto es que resulta aún más frecuente verlos a través de las redes sociales de sus padres, en historias de Instagram, Facebook, canales de Youtube, etc. “Unos datos demostrados en 2019 cuando la firma de seguridad informática AVG hizo una encuesta en varios países, entre ellos España, concluía que el 23 % de los niños aparecía en las redes incluso antes de nacer, con instantáneas de las ecografías. Otro dato que se extraía de este informe es que el 81% de los bebés son expuestos con menos de seis meses de edad” (LONGO 2021). Este fenómeno es conocido como sharenting, que viene del inglés sharing (compartir) y de parenting (criar). Su significado resultaría algo así como “exponer información de los hijos”. Con este trabajo pretendemos analizar desde una óptica de la protección de datos europea este actuar que por su propia cotidianidad tanto hemos “normalizado”.

It’s very common nowdays to see minors on social media, acting as "influencers" or even with personal accounts "managed" by their parents. The truth is that it’s even more common to see them through their parents’social media, on Instagram’stories, Facebook, YouTube channels, etc. Some data showned in 2019 when the computer security firm AVG conducted a survey in several countries, among them Spain, concluded that 23% of children appeared on social media even before they were born, through snapshots of ultrasound scans. Another fact that was taken from this report is that 81% of babies under six months of age are also exposed to it. This phenomenon is known as sharenting, which comes from the union of the words sharing and parenting. Its meaning would be something like "expose information about the children". With this work we intend to analyze from a European data protection point of view this action, that due to its common nature we have so much “normalized”.
