En este estudio abordaremos la protección del diseño industrial comunitario no registrado, el
cual pertenece a la familia de la propiedad industrial y que surgió en un ámbito comunitario
en 2001 por medio del Reglamento sobre Dibujos y Modelos Comunitarios (RDMC). Estamos
ante una figura jurídica híbrida ya que adopta características propias de las patentes, así
como de los derechos de autor.
El derecho industrial comunitario no registrado surge para dar protección a los dibujos y
modelos caracterizados por tener una breve vida comercial, lo cual se contrapone con una
larga vida útil. Se trata de diseños efímeros, basados en tendencias y temporadas cortas para
los que no es conveniente una protección copiosa y costosa, como la prevista para los
diseños industriales registrados.
No obstante, aunque esta nueva figura se caracteriza por sus grandes ventajas con respecto a
determinados sectores, también afronta retos en relación con su protección, matices que
deben ser reformulados por el legisladores, los cuales abordaremos en esta tesis.

In this study we will deal with the protection of the unregistered industrial design, which
belongs to the family of industrial property and which emerged at Community level in 2001
through the Regulation on Industrial Design (RDMC). This is a hybrid legal concept as it
adopts characteristics of both patents and copyrights.
The unregistered industrial design arises to provide protection for designs characterised by a
short commercial life, as opposed to a long useful life. We are dealing with ephemeral
designs, based on short trends and seasons, for which a long and costly protection, such as
that provided for registered industrial designs, is not appropriate.
However, although this new figure is characterised by its great advantages with respect to
certain sectors, it also faces challenges in relation to its protection, nuances that must be
reformulated by legislators, which we will address in this thesis.
