| dc.description | When the fundamental rights of the personality conflict with the multiplicity of interests that we find in the anarchic and without border limits environment such as the Internet, the freedoms of expression and information of article 20 of the Constitution can be as threatened as the rights to privacy, honor and image of article 18.1, guaranteed in its computing aspect by section 4. Since these rights are mutually limited and present a natural conflict, we will analyze it through the texts that address and we will conclude that the exercise of the "right to be forgotten" may not be as effective as we would like it to be and that would carry the risk of feeding a "retrospective censorship" in relation to the correctly published information in the past, which could be affected by its recognition without the necessary limitations. | es_ES |
| dc.description.abstract | Cuando los derechos fundamentales de la personalidad entran en conflicto con la multiplicidad de intereses que encontramos en el medio anárquico y sin límites fronterizos como es Internet, las libertades de expresión e información del artículo 20 de la Constitución pueden verse tan amenazadas como los derechos a la intimidad, al honor y a la propia imagen del artículo 18.1, garantizados en su vertiente informática por el apartado 4. Puesto que estos derechos se limitan mutuamente y presentan un conflicto natural, analizaremos este a través de los textos que lo abordan y concluiremos que el ejercicio del «derecho al olvido» puede no ser tan eficaz como quisiéramos y que comporta el riesgo de alimentar una «censura retrospectiva» en relación con las informaciones correctamente publicadas en su día, que podrían verse afectadas por su reconocimiento sin las necesarias limitaciones. | es_ES |
