dc.descriptionThe armed conflict in Colombia has lasted for more than 60 years and has left in its wake more than 10 million victims to date, a situation evidenced by the Constitutional Court of Colombia as the highest protective body of the Constitution in one of the most emblematic sentences in relation to conflict T-025 of 2004, where it ordered the Colombian State to adopt and implement positive policies, programs or measures to achieve real equality of conditions and opportunities for progressive satisfaction of the basic economic, social and cultural rights of the victim population. The orders of the Constitutional Court led to the formulation and implementation in domestic law of various mechanisms of transitional justice with laws that were promulgated by the Congress of the Republic, first, through Law 975 of 2005 of Justice and Peace signed to achieve the demobilization of paramilitary or self-defense groups -AUC, second, Law 1448 of 2011 called the Victims and Land Restitution Law, and finally, the End Point Agreement for the end of the conflict and the construction of a stable peace and durable signed with the FARC guerrilla group that in the end achieved its incorporation into civil life, legal tools proposed to comply with and prevail the rights presented by the transition, the right to truth, justice and reparation, with guarantees of no repetition of the victims.es_ES
dc.description.abstractEl conflicto armado en Colombia ha perdurado por más de 60 años y ha dejado a su paso más de 10 millones de víctimas a la fecha, situación evidenciada por la Corte Constitucional de Colombia como máximo órgano protector de la Constitución en una de las sentencias más emblemáticas en relación al conflicto T-025 de 2004, donde ordenó al Estado colombiano adoptar e implementar políticas, programas o medidas positivas para lograr una igualdad real de condiciones y oportunidades de satisfacción progresiva de los derechos económicos, sociales y culturales básicos de la población víctima. Las ordenes de la Corte Constitucional condujo a la formulación e implementación en el derecho interno de varios mecanismos de justicia transicional con leyes que fueron promulgadas desde el Congreso de la República, primero, a través de la Ley 975 de 2005 de Justicia y Paz firmada para lograr la desmovilización de los grupos paramilitares o Autodefensas -AUC, segundo, la Ley 1448 de 2011 llamada Ley de Víctimas y de Restitución de Tierras, y por último, el Acuerdo de Punto Final para la terminación del conflicto y la construcción de una paz estable y duradera firmado con el grupo guerrillero de las FARC que al final logró su incorporación a la vida civil, herramientas jurídicas propuestas para dar cumplimiento y prevalencia a los derechos que presenta la transicionalidad, el derecho a la verdad, justicia y reparación, con garantías de no repetición de las víctimas.es_ES
