Este trabajo tiene como objeto analizar la ejecución del laudo arbitral
extranjero en el Ecuador, especialmente, a partir de la Ley Orgánica para el Fomento
Productivo la cual implemento reformas a la Ley de Arbitraje y Mediación y al Código
Orgánico General de Procesos. La investigación comprende un análisis histórico
descriptivo de la ejecución del laudo extranjero, tratar de fijarsu definición, clases de
laudos y procedimiento. Los instrumentos utilizados para el estudio del tema son los
instrumentos internacionales y normativa nacional relacionados con la materia,
teniendo como conclusión que los mecanismos existentes en la actualidad para la
ejecución de laudos arbitrales extranjeros permiten actualmente mayor celeridad en
la ejecución de dichos instrumentos dejando a un lado el proceso de homologación
implementado por la normativa procesal ecuatoriana.
Descripción:
The purpose of this work is to analyze the execution of the foreign arbitration
award in Ecuador from the publication of the Organic Law for Productive Promotion,
which implemented reforms to the Arbitration and Mediation Law and to the General
Organic Code of Processes. The investigation includes a descriptive historical analysis
of the execution of the foreign award, as well as studying its definition, types of
awards and procedure. The instruments used for the study of the subject are
international instruments and national regulations related to the subject, having as
conclusion that the execution of foreign arbitration award currently allows greater
speed in the execution of the award leaving aside the approval process implemented
by the Ecuadorian procedural regulations.
