Ya se lo preguntaba Descartes, ¿podrán las máquinas llegar a pensar? Y es que,
en esta 4ª Revolución Industrial, este escenario es cada vez más real. Quizás, la
Inteligencia Artificial sea su máximo exponente; aquella que da lugar a contenidos de
naturaleza artística, entre otros, autónoma e independientemente del hombre. Pero,
¿a quién atribuir la titularidad de los derechos, toda vez que, a priori, una máquina
no necesita ser recompensada con un derecho exclusivo sobre su creación para
incentivarla a que produzca? En este trabajo se van a abordar los retos jurídicos a los
que estamos expuestos, a través de un estudio cualitativo, de las legislaciones de
diversos países; las más importantes resoluciones de tribunales nacionales,
comunitarios e internacionales; y las reflexiones de la doctrina más renombrada.
Todo ello, con una única finalidad: arrojar luz en este camino hacia una inteligencia
desconocida y que ha venido para quedarse.

As Descartes wondered, will the machines ever be able to think? In this 4th
Industrial Revolution, this scenario is becoming increasingly real. Perhaps, Artificial
Intelligence is its maximum exponent; that which gives rise to contents of an artistic
nature, among others, in an autonomous and independent way from men. But, who
to attribute the ownership of the rights since, a priori, a machine does not need to
be rewarded with an exclusive right over its creation to encourage it to produce?
Throughout this study, we will address the legal challenges to which we are exposed,
through a qualitative analysis, which will dive into the laws of various countries, the
most important decisions of national, European and international courts, and will go
to the thoughts of the most renowned doctrine. All of this with a single purpose: to
shed light on this path towards an unknown intelligence that has come to stay.
