dc.descriptionThis article offers a comparative analysis of the separate opinions accompanying Advisory Opinion OC-32/25 of the Inter-American Court of Human Rights on the climate emergency and human rights, focusing specifically on the recognition of nature as a subject of rights. Through an argumentative and cross-cutting examination of concurring and dissenting opinions, the positions of the judges are addressed along the anthropocentrism/ecocentrism axis, highlighting both points of convergence and the methodological tensions observed within the Court. The article argues that Advisory Opinion OC-32/25 adopts a deliberately open stance, which explains both the enthusiasm of the concurring opinions and the intensity of the dissents. It also underscores the decisive influence of Indigenous Peoples in the construction of an ecocentric paradigm, as well as the limits that some judges propose in defense of legal certainty, institutional legitimacy, and the sovereign will of States;differences in approach that greatly enrich the debate on the rights of nature.
dc.description.abstractEl presente artículo ofrece un análisis comparativo de los votos separados que acompañan a la Opinión Consultiva 32/25 de la Corte Interamericana de Derechos Humanos sobre la emergencia climática y los derechos humanos, centrado específicamente en el reconocimiento de la naturaleza como sujeto de derechos. A través de unexamen argumentativo y transversal de los votos concurrentes y disidentes, se abordanlas posiciones de los juecesal respecto,destacando tanto los puntos de convergencia como las tensiones metodológicas observadas en el seno del tribunal. El artículo sostiene que la OC-32/25 adopta una posición deliberadamente abierta,lo que explica tanto el entusiasmo de los votos concurrentes como la intensidad de las disidencias. También se subraya la influencia decisiva de los pueblos indígenas en la construcción de un paradigma ecocéntrico, así como los límites que algunos juecesplantean en defensa de la seguridad jurídica, la legitimidad institucional y la voluntad soberana de los Estados; diferencias de criterio que enriquecen enormemente el debate sobre los derechos de la naturaleza.
