| dc.description | Surrogate motherhood is currently an option to become parents whose ethical assessment and social acceptance is subject to controversy, being its regulation heterogeneous. The possible framing of surrogate motherhood in Spanish legislation goes through its inclusion in the juridical figure of filiation, within which it is worth highlighting the affiliation as a result of assisted reproduction techniques. These techniques are inseparable from surrogate pregnancy, to the point that the Assisted Human Reproduction Techniques Law is the only legal text that explicitly cites it, to prohibit it. In this paper, both concepts are analysed legally, the position of the Dirección General de Registros y del Notariado as well as that of the Supreme Court, and the state of the matter is studied in the surrounding countries to conclude by analysing the situation of the surrogate pregnancy in California as a reference internationally. | es_ES |
| dc.description.abstract | La maternidad subrogada es actualmente una opción para convertirse en padres cuya valoración ética y aceptación social es objeto de controversia, siendo su regulación heterogénea. El posible encuadre de la maternidad subrogada en la legislación española pasa por su inclusión en la figura jurídica de la filiación, dentro de la cual cabe destacar la filiación a consecuencia de las técnicas de reproducción asistida. Estas técnicas son indisociables a la gestación subrogada, hasta el punto de que la Ley de Técnicas de Reproducción Humana Asistida es el único texto legal que la cita explícitamente, para prohibirla. En este trabajo se analizan jurídicamente ambos conceptos, la posición de la Dirección General de Registros y del Notariado así como la del Tribunal Supremo, y se estudia el estado de la cuestión en los países de nuestro entorno para culminar analizando la situación de la gestación subrogada en California como referente a nivel internacional. | es_ES |
