En nuestra historia jurídica estaba admitido que las acciones las cometían las personas, no las
empresas. Sin embargo la creciente criminalidad económica nos ha llevado a tener que
organizar un sistema jurídico que evite o al menos aplaque las consecuencias de la criminalidad
de las personas jurídicas.
Pero no es hasta el siglo XXI, y más en concreto con la proclamación de la LO 5/2010, cuando
en nuestro país se regula un sistema penal independiente sancionador orientado a las personas
jurídicas. En poco tiempo se vio la necesidad de modificar la Ley y así surge la actual normativa
recogida en la LO 1/2015 cuya principal novedad es la implantación de métodos de prevención
y control de delitos en aras a un sistema de entes jurídicos transparente y para poder perseguir
eficientemente los crecientes delitos tributarios.

In our legal history it was admitted that actions were committed by people, not by companies.
However, this change has led to a growing economic crime born in large companies and this
has led us to have to organize a legal system that avoids or at least alleviates the consequences
at a social level.
But it is not until the XXI century, and more specifically with the proclamation of the LO
5/2010, when our country regulated an independent penal sanctioning system oriented to the
legal persons. In a short time the need to modify the Law was seen and so the current regulations
contained in the LO 1/2015 arises. The main novelties are the implementation of methods of
prevention and control of crimes in favor of a system of transparent legal entities and to be able
to efficiently prosecute the growing tax crimes
