| dc.description | This Master's thesis deals with a legal opinion, it is specialized in Family Law, in which Mr. Alberto raises a series of questions after deciding to dissolve his marriage to his wife, Ms. Leticia. After studying the case, an exhaustive approach has been made in order to present the different channels that the client may face, whether he opts for separation or he decides to file for divorce, analyzing the substantive and procedural issues of both procedures. A global vision of the consequences in carrying out both procedures will be presented to Mr. Alberto so he can decide which one best suits his needs. Therefore, the resolution of the verdict is consolidated by applying the current legislation at the time of issuing it, as well as the case will be argued with the support of the jurisprudence and the most relevant doctrine. | es_ES |
| dc.description.abstract | El presente Trabajo Fin de Máster versa sobre un dictamen jurídico, especializado en el Derecho de Familia, donde Don Alberto plantea una serie de cuestiones tras tomar la decisión de poner fin al matrimonio con su esposa, Doña Leticia. Tras el estudio del caso, se hace un planteamiento exhaustivo de las diferentes vías a las que se puede enfrentar el cliente, tanto si opta por la separación, como si su decisión es firme y decide instar el divorcio, haciendo un análisis de las cuestiones sustantivas y procesales de ambos procedimientos. Don Alberto podrá tener una visión global de cuáles serán las consecuencias de llevar a cabo un proceso u otro y podrá decidir cual se adapta mejor a sus necesidades. Por ello, la resolución del dictamen se consolida aplicando la legislación vigente en el momento de la emisión del mismo, así como, argumentando las respuestas con el apoyo de jurisprudencia y doctrina más relevante al supuesto de hecho. | es_ES |
