| dc.description | The figure of the DPD seems something new but, in this work, we will determine its evolution and current situation. We have also seen what makes the designation of this figure mandatory in the entities, their position, functions and responsibility; covering many more aspects than those that the regulations on data protection (RGPD and LOPDGDD) have included in its articles, thanks to the instructions of the defunct WP29 and the AEPD, and the vision of professionals who work on data protection. As for the election, we have established what requirements the DPD itself must have to exercise it correctly. All these assessments have been adapted to the Education sector where, in addition to completing the data protection regulations with the sectoral regulation, we denote how the DPD has to exercise in order to comply with its obligations and go further with the principle of proactive responsibility. We end up with some activities or relationships that the DPD should always consider when it comes to education, such as consents, AMPA or new technologies. | es_ES |
| dc.description.abstract | La figura del DPD parece algo novedoso pero, en este trabajo determinaremos su evolución y situación actual. También hemos visto qué hace obligatoria la designación de esta figura en las entidades, su posición, funciones y responsabilidad; abarcando muchos más aspectos que los que la normativa en materia de protección de datos (RGPD y LOPDGDD) ha recogido en su articulado, gracias a las instrucciones del extinto WP29 y la AEPD, y la visión de profesionales que trabajan la protección de datos. En cuanto a la elección, hemos establecido qué requisitos debe tener el propio DPD para poder ejercer correctamente. Todas estas apreciaciones se han ido adaptando al sector de la Educación donde, además completar la normativa de protección de datos con la regulación sectorial, denotamos cómo el DPD tiene que ejercer para poder cumplir con sus obligaciones e ir más allá con el principio de responsabilidad proactiva. Terminamos con algunas actividades o relaciones que el DPD siempre debe tener en cuenta en lo que a educación se refiere, como consentimientos, AMPA o nuevas tecnologías. | es_ES |
