| dc.description | This work, has been presented to show the value of the right to be forgotten in the protection of personal data, because it is important to raise awareness among all people of this right, it is in a constant evolution as disruptive technologies such as intelligence artificial or Blockchain. We analyze how the right to be forgotten has developed in the internet age, from its jurisprudential birth that has influenced other countries, to being recognized in the European (RGPD) and our national (LOPDGDD) regulations. It is a right that has limits in its laws, but is also closely linked to the exercise of other rights. Finally, after analysis of cases. We show, how we use new technologies and ask ourselves, if the next conflict of the right to be forgotten will be related to Artificial Intelligence, Blockchain or another that on the technological horizon. These circumstances place emphasis on the need to have mechanisms in place that avoid as much as possible the escalation of new conflicts. | es_ES |
| dc.description.abstract | El presente trabajo, se expone para poner en relieve la importancia de la concienciación del derecho al olvido en el marco de la protección de datos personales, se trata de un derecho en continua evolución, al igual que lo hacen las tecnologías disruptivas como lo es Blockchain. Analizamos cómo el derecho al olvido se ha ido configurando en la era online, desde su nacimiento jurisprudencial que ha influido en otros países, hasta ser reconocido en la normativa europea RGPD y nacional LOPDGDD. Es un derecho que tiene límites en su normativa, pero que además está muy ligado al ejercicio de otros derechos. Finalmente, tras analizar jurisprudencia y casuística actual, ponemos en perspectiva, nuestro comportamiento en el uso de nuevas tecnologías. Así como la necesidad de canales preventivos, para anticiparnos a próximos conflictos del derecho al olvido, relacionados con la Inteligencia Artificial, el Blockchain o cualquier otra que aparezca en el horizonte tecnológico. | es_ES |
