El delito de enaltecimiento y humillación de las víctimas del terrorismo en las redes sociales

Durante el último siglo las tecnologías han evolucionado hasta llegar a convertirse
en uno de los grandes medios de comunicación, a través de los cuales y de manera
continua, millones de personas intercambian y difunden información, lo que ha obligado
al legislador español a adaptar el Código Penal a la realidad social, amparando situaciones
que hasta el momento no estaban previstas en muchos de nuestros textos legales, y por lo
tanto carecían de cobertura.
De este modo se han creado delitos tales como el enaltecimiento del terrorismo y
el delito de humillación a las víctimas, regulados en el artículo 578 C.P. Tipos penales
que pretenden dar respuesta penal a actuaciones realizadas, supuestamente bajo el amparo
del derecho a la libertad de expresión y que, sin embargo, han llegado a poner en peligro
los derechos fundamentales de otros, tales como la dignidad, el honor o la propia imagen.
Descripción:
During the last century, technologies have evolved to become one of the great
means of communication, through which and continuously, millions of people exchange
and disseminate information, which has forced the Spanish legislator to adapt the Code
Criminal to the social reality, protecting situations that up to now were not foreseen in
many of our legal texts, and therefore lacked coverage.
In this way, crimes such as the glorification of terrorism and the crime of
humiliation to victims, regulated in Article 578 C.P. Criminal types that seek to give a
criminal response to actions carried out, supposedly under the protection of the right to
freedom of expression and which, however, have come to endanger the fundamental
rights of others, such as dignity, honor or their own image.
