En este trabajo de fin de máster se puede encontrar cómo ha sido la evolución que ha
experimentado la relación entre la medicina y el derecho a lo largo de la historia. Se
profundiza en el concepto de tratamiento médico y las diferencias existentes entre el
tratamiento médico curativo y el que no lo es. Se analiza cómo se encuentra en este momento
la responsabilidad del profesional sanitario, así como la litigiosidad en este campo.
También se analiza cómo el CP recoge a la actividad sanitaria, qué relevancia jurídico penal
tiene el tratamiento médico curativo, cómo se analiza la imprudencia en este ámbito y el papel
que tienen el deber de cuidado, la lex artis y el consentimiento del paciente. Se analiza por
último la autoría y participación a la hora de incurrir en un ilícito penal, para finalizar con un
análisis jurisprudencial de la temática y una conclusión del mismo analizando todo lo
planteado.

In this master's thesis, you can find out how the evolution of the relationship between
medicine and law has evolved throughout history. It delves into the concept of medical
treatment and the differences between curative medical treatment and that which is not. It is
analyzed how the responsibility of the healthcare professional is at this moment, as well as
the litigation in this field.
It is also analyzed how the CP collects the health activity, what legal relevance has the
medical curative treatment, how to analyze imprudence in this area and the role of the duty of
care, the lex artis and the consent of the patient. The authorship and participation at the time
of incurring in a criminal offense are analyzed, to finalize with a jurisprudential analysis of
the subject and a conclusion of the same one analyzing all the raised thing.
