La ORGA y la política de recuperación de activos en España

La criminalidad organizada constituye uno de los fenómenos delictivos más preocupantes a nivel internacional. Por ello, desde finales del siglo XX, las organizaciones internacionales más importantes han venido elaborando convenios con el objetivo de definir una solución común a todos los Estados, que permita luchar de forma efectiva contra este fenómeno. Esta solución es la política de recuperación de activos, o lo que es lo mismo, privar a las organizaciones criminales de los beneficios obtenidos con sus actividades delictivas. En España tiene el nombre de decomiso, y el órgano encargado de asistir a los órganos judiciales en esta tarea es la Oficina de Recuperación y Gestión de Activos (ORGA). En este contexto, el objetivo de este trabajo es analizar el marco normativo nacional e internacional del decomiso, comprender la estructura orgánica y funcional de la ORGA y, a través de un análisis estadístico, determinar si la ORGA es un órgano eficaz y eficiente en el cumplimiento de esta labor.

Organized crime is one of the most worrying criminal phenomena at the international level. For this reason, since the end of the 20th century, the most important international organizations have been drawing up conventions with the aim of defining a common solution to all States that will enable them to effectively combat this phenomenon. This solution is the policy of asset recovery, or in other words, depriving criminal organizations of the profits obtained from their criminal activities. In Spain it is called confiscation, and the body in charge of assisting the judicial bodies in this task is the “Oficina de Recuperación y Gestión de Activos (ORGA)”. In this context, the aim of this paper is to analyze the national and international regulatory framework of confiscation, to understand the organizational and functional structure of ORGA and, through a statistical analysis, to determine whether ORGA is an effective and efficient body in the performance of this task.
