Resumen:
Este trabajo aborda el transporte de nitratos a bordo de buques de carga, haciendo hincapié
en el caso concreto del buque Cheshire que transportaba fertilizante NPK, el cual sufrió un
grave accidente provocado por la explosión del abono a base de nitrato amónico exigiendo
evacuar a la tripulación y llevar a cabo una operación de salvamento marítimo. Mediante el
uso de los códigos internacionales, la ficha de seguridad del producto y los hechos acaecidos,
se prueba la conducta dolosa del cargador al realizar la estiba a granel del abono, debiéndose
prohibir esta práctica dado el gran riesgo que entraña esta mercancía y ha de ser considerada,
en todo caso, peligrosa.
Descripción:
This paper explores the maritime transport of nitrates, emphasizing the case of the motor
vessel Cheshire, which suffered a serious accident caused by the explosion of ammonium
nitrate fertilizer requiring evacuation of the crew and carry out a salvage operation. By using
the international codes, the safety data sheet of the product and the facts that have occurred,
the wilful conduct of the shipper has been proven when the bulk stowage of the fertilizer is
carried out. This practice should be prohibited because of the great risk involved in this
fertilizer and must be considered as a dangerous good in any case.
