La propiedad intelectual e industrial tienen como objetivo el incentivo de la innovación y la investigación en las distintas áreas industriales, científicas y artísticas, protegiendo a los titulares de creaciones e invenciones frente a terceros. En este contexto, la protección jurídica de los programas de ordenador ha constituido tradicionalmente una de las mayores polémicas dentro de la doctrina jurídica, que no se ponía de acuerdo en cuál sería el mejor mecanismo para poder llevar a cabo dicha protección, optándose generalmente por el sistema de los derechos de autor a nivel mundial. No obstante, existen otros mecanismos de protección que han sido planteados y que a día de hoy pueden ser utilizados para proteger el software en sus múltiples facetas, siendo el principal y más controvertido el sistema de patentes, y es por este motivo que resulta relevante estudiar el ordenamiento jurídico vigente y los límites que éste impone a dicha protección, así como las distintas corrientes de pensamiento existentes en la doctrina y jurisprudencia en España, Europa y Estados Unidos, para poder conocer las vías de protección existentes actualmente y analizar la eficacia de la patentabilidad del software, así como reflejar los múltiples retos jurídicos que plantea la protección de estas creaciones.

Intellectual and Industrial Property aims the incentive of innovation and investigation in the different industrial, scientific and artistic areas, protecting the owners of creations and inventions against third parties. In this context, legal protection of computer programs has traditionally been one of the biggest contentious issues in the legal community, which could not agree in which would be the best mechanism to carry out this protection, generally opting for the copyright system worldwide. However, there are other protection mechanisms which have been raised and which can be used nowadays to protect software in its multiple facets, being the patents system the main and most controversial one, and this is the reason why it is important to study the current legal framework and its limits to the referred protection, as well as the different trains of thought existing in the legal doctrine and jurisprudence in Spain, Europe and the United States of America, in order to be able to know the different ways of protection currently available and the effectiveness of the software patentability, just as to reflect the multiple legal challenges that the protection of this creations raises.
