La Protección de Datos Personales en la Relación Laboral: estudio comparado de España y Ecuador

En la mayoría de ordenamientos jurídicos existen leyes que regulan la protección de datos de
carácter personal, el acceso y la decisión sobre información y datos de este carácter, la
recolección, archivo, procesamiento, distribución o difusión de estos datos. Sin embargo, en
Ecuador existe una incipiente regulación en este sentido, con la recién aprobada Ley
Orgánica de Protección de Datos Personales, publicada en el Registro Oficial el 26 de mayo
de 2021. Motivo por el cual, se vuelve imprescindible realizar un análisis pormenorizado
sobre la existencia de una adecuada regulación y protección de los datos personales de los
trabajadores, ya que no existe una normativa específica en este tema, siendo necesario
brindar a los trabajadores y empleadores una investigación que procure dar una
profundización en las particularidades del tratamiento, uso y conservación de datos
personales en una relación laboral.

In most legal systems there are laws that regulate the protection of personal data, access and
decision on information and data of this nature, the collection, filing, processing, distribution
or dissemination of these data. However, in Ecuador there is an incipient regulation in this
regard, with the recently approved Organic Law on the Protection of Personal Data,
published in the Official Registry on May 26, 2021. For this reason, it is essential to carry out
a detailed analysis on the existence of an adequate regulation and protection of the personal
data of the workers, since there is no specific regulation on this subject, being necessary to
provide the workers and employers with an investigation that seeks to deepen the
particularities of the treatment, use and retention of personal data in an employment
relationship.
