Las causas de despido disciplinario del ET: especial referencia al acoso discriminatorio

La proporcionalidad y graduación de las sanciones por las faltas cometidas por los
trabajadores se constituye en un principio que afecta sustancialmente al despido disciplinario,
adecuando la sanción a la persona, a los hechos cometidos. Y este principio también debe
aplicarse a aquellos despidos disciplinarios en razón a acoso, en las diferentes modalidades
presentadas en el apartado g del art. 54.2 del ET, el llamado acoso discriminatorio en el ámbito
laboral.
El incumplimiento contractual del trabajador, grave y culpable, por razón de acoso
conlleva derivaciones de carácter penal conforme al art. 314 del CP dedicado al delito por
discriminación laboral que son examinadas con estudio, derivaciones que no pueden justificar
responsabilidad penal por la mera existencia de una acción discriminatoria, sino que requiere
de otros elementos en juego.

The proportionality and graduation of penalties for misdemeanors committed by
workers is a principle that substantially affects disciplinary dismissal, when the sanction to the
person is adapted to the acts committed. This principle should also apply to disciplinary
dismissals on grounds of harassment, in the various forms set out in article g. 54.2 of the Status
of workers, the so-called discriminatory harassment in the field of work.
The serious and guilty breach of contract by the worker by reason of harassment
entails criminal consequences in accordance with art. 314 of the Penal Code for offense of
discrimination, which are examined with study and cannot justify criminal liability for the mere
existence of a discriminatory action but requires other elements at stake.
