Este trabajo presenta un estudio del terrorismo yihadista en Europa a partir
de los atentados cometidos por las Organizaciones terroristas Al Qaeda y Dàesh,
por medio de individuos integrados en células terroristas o los denominados “lobos
solitarios”. Se pretende dar un enfoque penal y jurisprudencial respecto a la
investigación aplicada. Para ello, haremos un breve repaso por la historia del
terrorismo, y de conceptos afines para situar al lector en un entorno apropiado para
entender el trasfondo de dicho trabajo.
Se va a dividir la investigación en dos partes: por un lado se realizará un
análisis conceptual e histórico del terrorismo yihadista, y por otro, el tratamiento que
el derecho sustantivo y el derecho procesal dan a estas conductas ilícitas, es decir,
los delitos y las penas asociadas, y las normas procesales seguidas en la
investigación y judicialización del terrorismo, respectivamente.

This work presents a survey on jihadist terrorism in Europe from the attacks
committed by terrorist organizations Al Qaeda and Daesh, through individuals
integrated into terrorist cells or the so-called lone wolves. It is intended to give a
criminal and jurisprudential approach to research applied. To do this, we will briefly
review the history of terrorism, and related concepts to place the reader in an
appropriate environment to understand the background of this study.
The investigation will be divided into two parts: on the one hand, a conceptual
and historical analysis of jihadist terrorism will be carried out, and on the other hand,
the treatment that substantive law and procedural law give to these illicit behaviors,
that is, the offences and associated penalties, and the procedural rules followed in
the investigation and prosecution of terrorism, respectively.
