Tras seis años de la transposición de la Directiva 2014/17/UE en el ordenamiento jurídico español, el legislador español se encuentra, nuevamente, ante el reto jurídico de transponer la Directiva 2021/2167, para lo cual, ya se está tramitando en el Congreso de los Diputados el Proyecto de Ley de administradores y compradores de créditos. El presente artículo tiene como objetivos, en un primer lugar, poner en valor la Directiva 2014/17/UE, como factor relevante a la hora de reforzar el sistema hipotecario español, teniendo en cuenta el Informe de la Comisión al Parlamento Europeo y al Consejo relativo a la revisión de la Directiva 2014/17/UE, con la revisión de las particularidades que surgieron en España. El segundo objetivo será analizar el concepto de «tolerancia razonable» del acreedor en la futura regulación del artículo 25 bis de la Ley 5/2019, recogida en el Proyecto de Ley de administradores y compradores de créditos, como transposición de la Directiva 2021/2167.

Six years after the transposition of Directive 2014/17/EU into Spanish law, Spanish lawmakers are once again facing the legal challenge of transposing Directive 2021/2167, for which the Credit Administrators and Credit Purchasers Bill is already being processed in the Spanish Congress. The objectives of this article are, first, to highlight the importance of Directive 2014/17/EU as a relevant factor when it comes to strengthening the Spanish mortgage system, taking into account the Report from the Commission to the European Parliament and of the Council regarding the review of Directive 2014/17/EU, with a review of the peculiarities that arose in Spain. The second objective will be to analyze the concept of The creditor’s « reasonable forbearance» in the future regulation of Article 25 bis of Law 5/2019, included in the the Credit Administrators and Credit Purchasers Bill, as a transposition of Directive 2021/2167.
