Estudio jurídico comparado de la prisión permanente revisable de España y la cadena perpetua del Perú: coincidencias y diferencias a partir de su regulación penal respectiva

La prisión permanente revisable, recientemente introducida en el sistema penal español, es criticada debido a su posible inconstitucionalidad y problemas prácticos penitenciarios. Hay una sospecha jurídica de que se trate de una verdadera cadena
perpetua.
El presente trabajo pretende encontrar las semejanzas y diferencias jurídicas entre la prisión permanente revisable y la cadena perpetua. Para ello se acude a un sistema punitivo, como el de Perú, en el que se mantiene vigente y es muy aplicada la cadena perpetua como sustituta de la pena de muerte. Basado en el análisis jurídico desde la respectiva visión de la historia, la jurisprudencia, la opinión de los autores y los problemas prácticos que puedan suponer en España y Perú, se buscará determinar si la prisión permanente revisable es o no realmente una cadena perpetua.
El logro de dicho objetivo ayudará a determinar la necesidad de que permanezca vigente el actual régimen sobre la prisión permanente revisable. De consistir en una verdadera cadena perpetua, el régimen penal español no solo se convertiría en el sistema más duro de Europa, sino que también significaría la crisis del sistema punitivo occidental humanitario y garantista y la edad de oro de la pena de prisión.

The recently introduced permanent reviewable imprisonment in the Spanish penal system is criticized because of its possible non-constitutional and practical penitentiary problems. There is a juridical suspicion that this is a life imprisonment rather than a permanent reviewable imprisonment.
This work pretends to find the similarities and juridical differences between the permanent reviewable imprisonment and the life imprisonment. This study is carried out with the revision of the punitive system of Peru, where life sentence is applied as a substitute for the death penalty. Based on the legal analysis from the perspective of the history, the jurisprudence, the opinion of the authors and the practical problems that could be found in Spain and Peru, this work intends to determine whether the permanent reviewable imprisonment is or not really the life imprisonment.
The achievement of the said objective will help to determine the necessity of the current permanent reviewable imprisonment, which is in force. Whereas, if it is found to be a life imprisonment, then the Spanish penal system is not only the toughest system in Europe but would also mean the crisis of the occidental humanitarian punitive guarantee system and the golden era of punishment in prison.
