Este artículo analiza la naturaleza jurídica del recargo de prestaciones en materia de Seguridad Social (art. 164 TRLGSS). Como estudio preliminar, se exponen, por un lado, los antecedentes históricos y, por otro, los caracteres fundamentales del recargo de acuerdo con el actual régimen jurídico. A partir de estos últimos se extrae la naturaleza sancionadora del instituto, los cuales, no obstante, no permiten catalogarlo satisfactoriamente como sanción, sino como pena privada, ya que, ante todo, el recargo de prestaciones presenta una serie de características que se ubican conceptualmente en las propias de las instituciones aflictivas, sin embargo, también se aprecian algunos rasgos de las reparadoras.

This article analyzes the surcharge on Social Security benefits' legal nature (art. 164 TRLGSS). As an introductory phase, an exposition of the historical background and its fundamental features is made. From the latter it is possible to extract the sanctioning nature of the institute, which, however, does not allow it to be satisfactorily qualified as a sanction, but as a privative punishment, since, above all, the surcharge of benefits presents a series of characteristics that are conceptually located in those of the afflictive institutions, however, some features of the restorative ones can also be appreciated.
