La última jurisprudencia del Tribunal Supremo declara que la incapacidad permanente para el servicio, derivada de accidente de tráfico sufrido por un funcionario público al realizar el desplazamiento para ir o al volver del centro de trabajo, puede considerarse como incapacidad producida “como consecuencia del servicio” a los efectos de la obtención de pensión extraordinaria regulada en el artículo 47.2 del Texto Refundido de la Ley de Clases Pasivas del Estado.
Descripción:
The latest case law of the Supreme Court declares that permanent incapacity for service suffered as a result of a traffic accident sustained by a civil servant when travelling to or from work can be considered as incapacity “as a consequence of service” for the purposes of obtaining the extraordinary pension regulated in article 47.2 of the Consolidated Text of the State Pensioners’ Pension Act.
