Estafas piramidales y modalidad bot cometidas mediante el uso de criptodivisas

El avance y la innovación tecnológica han propiciado el surgimiento y desarrollo de monedas virtuales que, influidas por las redes sociales y las necesidades económicas, han disparado estrepitosamente su demanda mundial.
El desarrollo industrial en el sector de la robótica y en la programación, la escasez de conocimientos en áreas: bursátil, tecnológica, económica, IA, técnicas de manipulación y modus operandi delictivos, aunados a un exceso de confianza del inversor y al uso de información falsa en el marketing en los mercados de criptodivisas, ha sido aprovechado por los reos del delito en el empleo de un sistema antiguo de estafa: la estafa piramidal.
La inexistencia en España de regulación de este delito especial y de un organismo regulador de criptomonedas y de los mercados de criptoactivos, ha posicionado al inversor en una situación de desprotección y al condenado en una situación beneficiada por la carencia de tratamiento punitivo más severo adecuado a las especiales características de este delito especial.

Advancement and technological innovation have led to the emergence and development of virtual currencies that, influenced by social networks and economic needs, have skyrocketed their global demand.
Industrial development in the robotics sector and in programming, the lack of knowledge in areas: stock, technological, economic, AI, manipulation techniques and criminal modus operandi, together with an excess of investor confidence and the use of information false in the marketing in the cryptocurrency markets, has been exploited by the criminals in the use of an old scam system: the pyramid scam.
The non-existence in Spain of regulation of this special crime and of a regulatory body for cryptocurrencies and crypto-asset markets, has placed the investor in a situation of vulnerability and the convicted person in a situation benefited by the lack of more severe punitive treatment appropriate to the special characteristics of this special crime.
