dc.descriptionThe aim of this work is to identify the basic elements involved in the management and administrative organization in public-funded joint research centers. This type of centers are constituted at least by two public institutions which, in spite of preserving their own legal identity and personality, also implement a new instrumental body with its own legal independence and administrative personality. The management of the administration of this new body is shaped and bound by its specific legal and organization nature. In order to achieve this aim, we will study different aspects related to the general legal situation and organization of a joint center, as well as to the particular managing and administrative peculiarities derived from their special nature. Moreover, we will present an analysis of the legal framework existing in Spain, which determines the rules applied to these joint administrative bodies. This work will develop empirical research in a Joint Research Center where two public institutions need to jointly implement the management of the joint body, from the creation of the center and from its original identity to its daily development. We will thus analyze the management and administrative organization in a real case study, The Center for Materials Physics (CFM), which is a Joint Center co-managed by the Spanish Council for Scientific Research (CSIC) and the University of the Basque Country (UPV/EHU), and conclude with a proposal to improve these management and organization tasks in the Center which could be generally extended to other centers of similar nature.es_ES
dc.description.abstractEl objeto de este trabajo es identificar los elementos básicos para la gestión y para la organización administrativa en Centros de Investigación Mixtos de iniciativa pública. Estos centros están integrados por un mínimo de dos organismos públicos que, manteniendo su propia identidad y personalidad jurídica, desarrollan una nueva entidad de carácter instrumental, con identidad propia y carente de personalidad jurídica. La gestión de la administración de esta nueva entidad está condicionada por la singularidad de su naturaleza jurídica y organizativa. Para ello, estudiaremos cuestiones relativas a su forma jurídica y a su organización, en general, así como al funcionamiento y gestión administrativa en particular. Además, presentamos un análisis del marco normativo existente en España sobre estas instituciones administrativas mixtas. Además, este trabajo desarrolla una investigación empírica en un Centro de Investigación Mixto en el que dos organismos públicos deben desarrollar, conjuntamente, la gestión de la entidad mixta, desde su constitución y desde su identidad de origen hasta su desarrollo diario. Así, vamos a analizar la gestión y la organización administrativa en un caso real, el Centro Física de Materiales (en adelante CFM), que es un Centro de Investigación Mixto cogestionado por el Centro Superior de Investigaciones Científicas (en adelante CSIC) y la Universidad del País Vasco Euskal Herriko Unibertsitatea (UPV/EHU en adelante), para concluir con una propuesta de mejora extrapolable a centros de similar naturaleza.es_ES
